TorqueTrailPulse Terms of Service

1. Acceptance of These Terms

These Terms of Service ("Terms") form a legal agreement between you and TorqueTrail for your use of the TorqueTrailPulse iOS app ("App") and website ("Website"). By downloading, accessing, or using the App or Website, you agree to these Terms.

2. Eligibility

You must be at least the age of majority in your location, or have valid parental/guardian permission where required by law, to use the App.

3. License and Intellectual Property

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, lawful use. The App, design, software, trademarks, and content are owned by TorqueTrail or its licensors and are protected by applicable intellectual property laws.

You may not:

• copy, modify, reverse engineer, decompile, or redistribute the App except where law permits,
• use the App to break laws, harm others, or interfere with services,
• remove or alter ownership notices.

4. Acceptable Use and Safety

You are responsible for safe and lawful use of your vehicle and device. Do not interact with the phone while driving. If driving, use legal hands-free workflows and only when safe.

CarPlay support (if available) is read-only summary oriented and does not remove your duty to drive safely.

5. Telemetry Estimates Only

TorqueTrailPulse provides estimated values, including but not limited to: 0-100 km/h time, braking distance, longitudinal/lateral g-force, smoothness/vibration score, distance, and elevation delta.

These values are informational only and can vary due to device model, mounting, sensor quality, calibration, terrain, weather, and other factors.

App outputs must not be treated as precise measurement tools and must not be solely relied on for medical, legal, insurance, enforcement, or safety-critical decisions.

6. Exports and Sharing

GPX export and encrypted manual export are generated on-device only when you choose to export. Optional private iCloud backup uploads selected app data to your private iCloud account using CloudKit only when you enable it.

You are solely responsible for where and with whom you share exports, where you store manual backup files, and how you manage access to your private iCloud account and any export passphrases.

7. Availability and Changes

Core features are designed to work offline. Some optional behaviors (for example, Live Activity status during recording) may depend on iOS/device support and can change over time.

8. No Warranty

The App is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of accuracy, reliability, merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of Liability

To the fullest extent permitted by law, TorqueTrail and its affiliates are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of data, profits, business, or goodwill resulting from use of (or inability to use) the App.

10. Indemnity

You agree to defend, indemnify, and hold harmless TorqueTrail from claims, liabilities, damages, and expenses arising from your misuse of the App, your violation of these Terms, or your violation of law.

11. Suspension or Termination

We may suspend or terminate access to the App if you violate these Terms, misuse the service, or where required for legal/security reasons.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of India, excluding conflict-of-law principles.

Disputes will be subject to the exclusive jurisdiction of the courts at Nashik, Maharashtra, India, unless mandatory law requires otherwise.

13. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will update the "Last Updated" date. Continued use after changes means you accept the updated Terms.
